Terms of Service

Use our products for their intended purpose, don't abuse them, and understand that they are provided as-is by a small company doing its best.

These terms are an agreement between you and B.C. Joe LLC ("we", "us") and govern your use of this website and every product we operate, including isitinstock.com (together, the "Services"). By using the Services you agree to these terms. If you don't agree, please don't use them.

  1. Eligibility. You must be at least 13 years old to use the Services, and old enough to form a binding contract where you live (or have a parent or guardian's permission).
  2. Your account. Some features require an email address. You are responsible for the address you give us and for activity that happens through sign-in codes sent to it. Tell us promptly if you believe your account has been used without permission.
  3. Acceptable use. You agree not to:
    • use the Services to break the law or infringe anyone's rights;
    • send unsolicited messages, or point the Services at people who haven't asked to be notified;
    • probe, overload, scrape, or interfere with the Services or the systems behind them, or bypass rate limits or access controls;
    • resell or commercially redistribute the Services or the data they produce without our written permission;
    • use the Services in a way that harms us, other users, or the third-party websites the Services look at.
    We may limit, suspend, or terminate access that we reasonably believe violates these terms.
  4. What the Services do — and don't guarantee. Our products observe information published by third parties (for example, whether a retailer's page says an item is in stock) and report what they see. We do not control those third parties, their pages change without notice, and their information may be wrong or delayed. We do not guarantee that any notification will be timely, accurate, or delivered at all, and you should not rely on the Services for anything where a missed or incorrect alert would cause serious harm. We are not affiliated with any retailer or website the Services monitor.
  5. Availability and changes. We may change, pause, or discontinue any part of the Services at any time. We will try to give notice for material changes, but we don't promise to. The Services are currently offered free of charge; if we ever introduce paid features, we will say so clearly before charging anyone.
  6. Your content and requests. Anything you enter into the Services (such as a URL to watch) remains yours. You grant us only the permission needed to do what you asked. You are responsible for making sure your requests don't violate the terms of the websites you ask us to look at.
  7. Our property. The Services, including their software, design, and names, belong to B.C. Joe LLC or our licensors. These terms don't give you any rights in them beyond using the Services as intended.
  8. Privacy. Our Privacy Policy explains what data we collect and why. It is part of these terms.
  9. Disclaimer of warranties. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION, TO THE FULLEST EXTENT PERMITTED BY LAW.
  10. Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, B.C. JOE LLC AND ITS MEMBERS, OFFICERS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR OPPORTUNITY (INCLUDING A PURCHASE YOU DIDN'T MAKE BECAUSE OF A MISSED OR LATE NOTIFICATION), ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US$50). Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
  11. Indemnity. You agree to defend and hold us harmless from claims and costs (including reasonable attorneys' fees) arising from your violation of these terms or your misuse of the Services.
  12. Termination. You may stop using the Services and delete your account at any time. We may suspend or end your access if you violate these terms or if we discontinue the Services. Sections that by their nature should survive (including 4, 9, 10, 11, and 14) do.
  13. Changes to these terms. We may update these terms. We will change the effective date above and, for material changes, notify account holders by email before they take effect. Continuing to use the Services after that means you accept the new terms.
  14. Governing law and disputes. These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute that can't be resolved informally will be brought exclusively in the state or federal courts located in New York, and you consent to their jurisdiction. Before filing anything, please write to us — most problems can be fixed with an email.
  15. General. These terms are the entire agreement between us regarding the Services. If any part is found unenforceable, the rest remains in effect. Our not enforcing a provision isn't a waiver of it. You may not assign these terms; we may assign them to a successor of the business.
